Albrecht Law PLLC Secures Major Appellate Victory in a Personal Injury Case

SPOKANE VALLEY, Washington — Albrecht Law, PLLC, a premier civil trial and appeal law firm, is proud to announce a significant legal victory at the Washington State Court of Appeals, Division III. The firm successfully appealed a trial court’s decision to dismiss a client’s personal injury lawsuit, retaining the client’s right to seek justice and fair compensation.

The case stems from a collision on March 7, 2022, in which the plaintiff, represented by Albrecht Law, was rear-ended while stopped at a red traffic light. The at-fault driver claimed the crash was the result of an unforeseeable sudden medical emergency, specifically a stroke, and successfully moved the trial court to dismiss the case on summary judgment.

Refusing to accept the dismissal, the legal team at Albrecht Law appealed the decision. On October 21, 2025, the Court of Appeals agreed with Albrecht Law’s arguments, ruling that genuine issues of material fact existed regarding whether the stroke actually caused the collision and whether the medical emergency was truly unforeseeable. The appellate court reversed the summary judgment, paving the way for the case to return to the trial court.

Currently, the defense has petitioned the Washington State Supreme Court to review the appellate decision. If the Supreme Court declines to hear the case, the appellate victory stands, and the lawsuit will immediately resume in the trial court. Regardless of the next procedural step, the Court of Appeals decision marks a massive milestone for the plaintiff.
